Digital Checkmark LLC ("Digital Checkmark", "we", "us") is a managed service provider (MSP) based in the United States. We offer managed IT, cybersecurity, compliance, process automation, and AI integration services to U.S. businesses.

2) Scope
This Policy applies to visitors, customers, and end users within the United States who interact with our websites, support portals, WhatsApp Business communications, and contracted services.
3) Information We Collect
Provided by you
- Account and contact data (name, email, phone, company, role).
- Support tickets, chat/WhatsApp messages, call recordings (where allowed).
- Billing details and transaction information.
- Content you upload or connect (e.g., logs, configs) during support.
Collected automatically
- Device and usage data (IP, browser, pages, timestamps).
- Diagnostics and telemetry from managed systems (per contract).
- Cookies or similar technologies for security and analytics.
From third parties
- Vendors, partners, and threat-intelligence providers.
- Identity providers (e.g., Microsoft/Google) when you single sign-on.
4) How We Use Information
- Deliver, maintain, and improve our services and automations.
- Provide support, incident response, and security monitoring.
- Authenticate users and prevent fraud or abuse.
- Comply with legal obligations and enforce agreements.
- Operate AI-powered features (see AI Processing).
- Send service notices and transactional messages (including via WhatsApp).
Legal basis (U.S.): contractual necessity, legitimate business interests (e.g., security, service improvement), and compliance with applicable laws.
5) AI Processing
Some features use Artificial Intelligence (AI) to classify requests, generate replies, or detect anomalies. We apply access controls, retention limits, and vendor agreements to safeguard data.
- Data scope: limited to necessary operational context.
- Vendor processing: When we use third-party AI providers, data is processed under confidentiality agreements. We do not sell personal data.
- Opt-out: You may request AI features be disabled by contacting us.
6) WhatsApp Business Communications
We use WhatsApp Business Platform (Cloud API) to send service updates and provide support within the U.S.
- Phone numbers and message content are processed by Meta Platforms in accordance with their terms.
- You can opt out at any time by replying
STOPor contacting us. - We retain messages for troubleshooting and compliance only.
7) Sharing & Disclosure
- Service providers (hosting, email, security, backup) under confidentiality obligations.
- Partners as needed to deliver contracted services (e.g., Microsoft, Google, cybersecurity vendors).
- Legal when required by U.S. law or to protect rights, safety, or systems.
- Business transfers in case of merger, acquisition, or reorganization.
8) Data Retention
We retain data only as long as needed to provide services, meet legal requirements, and maintain operational records in the U.S.
9) Security
We use layered safeguards: encryption in transit, network segmentation, MFA, least privilege, and ongoing monitoring. No system is 100% secure, but we continuously improve our defenses.
10) International Transfers
Digital Checkmark operates primarily within the United States. Data transfers outside the U.S. occur only when required for contracted services and are governed by appropriate safeguards.
11) Your Privacy Rights (U.S.)
- Access or request deletion of your personal information.
- Opt out of marketing or data sharing where applicable.
- Request corrections to inaccurate information.

13) HIPAA & Sensitive Data
As a U.S. MSP supporting healthcare entities, we comply with HIPAA when acting as a Business Associate. A signed Business Associate Agreement (BAA) is required before processing any Protected Health Information (PHI).
14) Children’s Privacy
Our services are for business use only and not directed to children under 13. We do not knowingly collect such data.
15) Changes to This Policy
We may update this Policy periodically to reflect operational, legal, or regulatory updates in the United States.
